These Terms of Service ("Terms") govern your access to and use of the Fika mobile application, the website at fikadaily.com, and any related services (collectively, the "Service") provided by Fika Media LLC, a Utah limited liability company ("Fika," "we," "us," or "our"). By creating an account or otherwise using the Service, you agree to be bound by these Terms.

Plain-English summary: Be 13+. Don't be a jerk to your accountability partners. You own what you create; you give us permission to operate the Service. Subscriptions auto-renew via Apple. We provide Fika "as is" — it's an accountability tool, not medical, financial, or professional advice.

1. Eligibility

You must be at least 13 years old to create an account. If you are between 13 and the age of majority in your jurisdiction, you confirm that a parent or legal guardian has reviewed and accepted these Terms on your behalf. Fika is not designed for use by anyone under 13, and we will close any account that we determine belongs to a child under 13.

You are responsible for the information you provide when creating an account and for keeping that information accurate and up to date. You are responsible for safeguarding your credentials and for all activity that occurs under your account. Notify us at support@fikadaily.com if you suspect unauthorized use of your account.

4. Accountability Partners and Teams

Fika's value comes from connecting you with people you choose. When you invite or accept a partner, or join a team, you agree that the data you choose to share with that partner or team will be visible to them according to the in-app sharing controls. You are responsible for the content you share and for the relationships you form. We may, but are not obligated to, intervene in disputes between users.

If a partner makes you uncomfortable, you can remove them from inside the app at any time. Egregious behavior may be reported to support@fikadaily.com, and we may suspend or terminate accounts that violate these Terms.

5. User Content

You own your content. The goals, habits, check-ins, notes, photos, and other materials you create or upload ("User Content") remain yours. You grant Fika a worldwide, royalty-free, non-exclusive license to host, store, reproduce, modify (only to the extent necessary for technical operations like resizing photos), display, and distribute your User Content solely to operate and provide the Service to you and the partners you've chosen to share with.

You represent that you have all rights necessary to upload your User Content and that doing so does not violate any law or any third party's rights.

6. Push Notifications and Communications

If you opt in to push notifications, we will send messages about partner activity, daily reminders, challenge updates, and other in-app events. You can turn notifications off at any time in iOS Settings. We may also send service-related email (e.g., account notices, security alerts) regardless of notification preferences. Marketing email is opt-in only and includes an unsubscribe link.

7. Subscriptions and Payments

Fika offers a free tier and a Premium subscription. Premium is sold through Apple's App Store using StoreKit.

8. Intellectual Property

The Service — including the Fika name and logo, application code, designs, copy, and trademarks — is owned by Fika Media LLC and protected by U.S. and international intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes, subject to these Terms.

9. Account Deletion

You can delete your account at any time inside the app (Settings → Account → Delete Account). Account deletion is permanent and removes your personal data from production systems within 30 days as described in our Privacy Policy. If you cannot access the in-app deletion flow, email support@fikadaily.com and we will delete your account.

Not medical, mental health, financial, or professional advice. Fika is a habit and accountability tool. It is not a substitute for professional advice or treatment. If you are experiencing a mental-health emergency, please contact a qualified professional or, in the U.S., dial 988.

The Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted availability. We do not guarantee that the Service will be error-free, that data will not be lost, or that any particular result will be achieved.

11. Limitation of Liability

To the maximum extent permitted by law, Fika Media LLC and its officers, members, employees, and agents shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses arising out of or related to your use of the Service. Our total aggregate liability for any claim arising out of or relating to these Terms or the Service is limited to the greater of (a) the amount you paid to Fika in the twelve months preceding the claim or (b) USD $100.

12. Apple App Store Terms

If you obtained the Fika app from Apple's App Store, you acknowledge that these Terms are between you and Fika Media LLC, not Apple, and that Apple has no obligation to provide maintenance and support for the app. Apple is a third-party beneficiary of these Terms and may enforce them against you. The standard Apple Licensed Application End User License Agreement (apple.com/legal/internet-services/itunes/dev/stdeula) applies to your use of the app in addition to these Terms; to the extent of any conflict regarding usage of the app on an Apple device, Apple's EULA controls.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms or to protect the Service or other users. You may stop using the Service at any time. Sections 5, 8, 10, 11, 14, and 15 survive termination.

14. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we'll revise the "Effective" date above and, where appropriate, notify you in-app or by email before the change takes effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.

15. Governing Law and Disputes

These Terms are governed by the laws of the State of Utah, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service shall be brought exclusively in the state or federal courts located in Utah County, Utah, and you consent to personal jurisdiction there. Nothing in these Terms limits any non-waivable consumer-protection rights you may have under applicable law.
